GENERAL TERMS AND CONDITIONS FOR HENRY MECHANICAL (Lic No. 855174)

These General Terms and Conditions govern the services provided by Henry Mechanical (Lic No. 855174). We may modify these Terms and Conditions at any time, and we recommend reviewing them before engaging our services.

1. SCOPE OF AGREEMENT

This agreement constitutes the entire understanding between the CUSTOMER and Henry Mechanical, superseding all prior negotiations, representations, or agreements, whether oral or written. Any amendments must be made in writing and accepted by both parties.

2. LIMITED WARRANTY

Henry Mechanical warrants its materials and workmanship to be free from defects for one year after completion unless otherwise specified in writing. This warranty does not cover damage caused by misuse, negligence, or Acts of God, including earthquakes. No warranty is provided for drain cleaning or refrigerant leaks. Manufacturer warranties take precedence over Henry Mechanical’s warranty. This is the sole and exclusive warranty provided.

3. UNFORESEEN CONDITIONS

If concealed or unknown conditions arise, the CUSTOMER agrees to accept responsibility for any additional labor, materials, or repairs required. Henry Mechanical does not investigate asbestos or hazardous materials. If such materials are found, work will pause until the CUSTOMER arranges for their removal, as required by law. The CUSTOMER agrees to indemnify Henry Mechanical from any claims, damages, or losses related to unforeseen conditions.

4. MAINTENANCE VISITS AND DAMAGE MITIGATION

If a maintenance visit is missed, the monetary value of the visit will not exceed the cost of the maintenance agreement. Henry Mechanical is not liable for water damage or other issues arising from delays in warranty service. The CUSTOMER must take reasonable steps to mitigate damages.

5. RECOMMENDATIONS NOT PERFORMED

If the CUSTOMER declines a recommended service, Henry Mechanical is not responsible for any resulting issues. In cases where a drain cleaning cable becomes stuck, the CUSTOMER is responsible for its removal and any necessary repairs. The CUSTOMER is also responsible for cleanup costs related to sewage spills or hazardous materials.

6. PAYMENT TERMS

All work is performed on an UP-FRONT PRICE basis, which includes materials, taxes, and labor. No itemized breakdown will be provided. Payment is due immediately upon completion of work. The CUSTOMER agrees that no deductions will be made for penalties, damages, or back charges. Failure to pay will result in work suspension, and Henry Mechanical is entitled to recover reasonable expenses incurred for the termination.

7. LICENSE, PERMITS, AND FEES

The CUSTOMER is responsible for obtaining and paying for all necessary permits, taxes, and license fees for the repair work. The CUSTOMER must also provide reasonable access for inspections required by administrative authorities. Any additional work mandated by such authorities will be billed separately at an UP-FRONT PRICE.

8. DISPUTE RESOLUTION AND CANCELLATION

In the event of a dispute, Henry Mechanical may terminate work immediately and shall be entitled to payment for all services rendered up to that point. If the CUSTOMER cancels a contract after signing but before work begins, a cancellation fee of 10% of the contract value or $1,000 (whichever is less) applies. If cancellation occurs after work has commenced, Henry Mechanical is entitled to 10% of the contract value or payment for work performed (whichever is greater).

9. NOTICE OF DEFECTIVE WORK

Upon work completion, the CUSTOMER must inspect for defects and notify Henry Mechanical within 48 hours if repairs are needed. Henry Mechanical must be given an opportunity to correct any issues. Failure to provide notice within 48 hours voids all warranties. The CUSTOMER agrees not to withhold payment due to claims of defective work.

10. LIMITATIONS OF WORK

Henry Mechanical is not responsible for work outside the scope of the agreement, including but not limited to carpentry, tile work, masonry, flooring, roofing, and painting. These are the CUSTOMER’s responsibility unless otherwise specified in writing.

11. TEXT MESSAGE COMMUNICATION

Henry Mechanical may use text messaging for service updates, appointment reminders, and important notifications. By providing your phone number, you consent to receive text messages from Henry Mechanical and third-party service providers.

12. AGREEMENT TO TERMS

By engaging Henry Mechanical, the CUSTOMER acknowledges and agrees to these Terms and Conditions.
